For this report, I went to the Washington County courthouse in Jonesborough to find out about a petition that was being filed by defense attorneys in the so-called Facebook murders case. I then reached out to the prosecution for comment.
The defense in the so-called Facebook murders case filed a petition Thursday afternoon saying they have new evidence.
Barbara Potter and Jenelle Potter were among those convicted of killing a young couple, Billy Payne, Jr. and Billie Jean Hayworth, in 2012.
Their attorneys say their new evidence includes previously unknown statements made by Jamie Lynn Curd, boyfriend of Jenelle. He pleaded guilty and testified against her.
Those statements were in a book written about the case by prosecutor Dennis Brooks.
Attorney Randy Fallin says those statements could change the outcome of the case.
"Our position is it should have been disclosed to us before trial which would have changed our approach to some of the witnesses,” Fallin said.
We reached out to Brooks for comment. He was unavailable but said in a statement:
“I will address that motion in the court system… It’s a court motion that will be fought in court, not on the news.”
